1. ASSUMPTION OF RISK

I understand that participating in the Event involves risks, including, but not limited to, physical injury, property damage, and other hazards. I acknowledge that pickleball is a sport that involves physical exertion and can result in injuries from, but not limited to, slipping, tripping, collisions with other players or objects, or contact with the ball or paddle. I freely and voluntarily assume all risks associated with my participation in this Event, whether they are known or unknown to me.

2. RELEASE OF LIABILITY

I, for myself, my heirs, executors, administrators, and assigns, release, waive, and discharge DINKiCAN Pickleball, its owners, event organizers, employees, volunteers, sponsors, and any related entities (collectively referred to as "DINKiCAN"), from any and all liability for personal injury, property damage, death, or other losses arising out of or related to my participation in the Event, including transportation to and from the venue. This release applies even if the injury or damage results from the negligence of DINKiCAN or others associated with the Event.

3. MEDICAL AUTHORIZATION

In the event of an injury, accident, or illness during my participation in the Event, I authorize DINKiCAN and its representatives to obtain medical care deemed necessary for my health and safety. I acknowledge that I am solely responsible for any costs associated with such medical care.

4. NON-DISCRIMINATION POLICY

DINKiCAN is committed to creating an inclusive and welcoming environment for all participants, regardless of race, ethnicity, nationality, gender, gender identity, sexual orientation, disability, age, religion, or any other characteristic protected by law. Discrimination, harassment, or exclusion of any kind will not be tolerated. By participating in this Event, I agree to treat all participants, staff, and volunteers with respect and dignity. Violation of this policy may result in my immediate removal from the Event without refund or compensation.

5. PHOTOGRAPHY AND MEDIA RELEASE

I grant DINKiCAN the right to use any photographs, videos, or other media taken during the Event for promotional, advertising, or other commercial purposes without compensation. I understand that these images may appear on DINKiCAN’s website, social media platforms, marketing materials, or in other publications.

6. COMPLIANCE WITH RULES AND REGULATIONS

I agree to abide by all rules, regulations, and instructions set forth by DINKiCAN and its representatives during the Event. I understand that failure to comply may result in my immediate removal from the Event without refund or compensation.

7. ACKNOWLEDGEMENT OF FITNESS

I certify that I am physically fit, have sufficiently trained for participation in the Event, and have not been advised otherwise by a qualified medical professional. I am aware that it is my responsibility to ensure that I am in good health and capable of participating in the Event.

8. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless DINKiCAN from any and all claims, damages, losses, liabilities, and expenses, including attorney’s fees, arising from or related to my participation in the Event.

9. GOVERNING LAW

This waiver and release shall be governed by and construed in accordance with the laws of the State of California. Any legal action arising from this agreement or my participation in the Event shall be brought exclusively in the courts located in California.

10. SEVERABILITY

If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
